1. ABOUT THIS NOTICE Focus Jadeline Sdn Bhd ("Focus Jadeline", "we", "us", "our") operates MyBina, a subscription service that reports on construction projects in Malaysia. This Notice explains what personal data we collect from you, why we collect it, who we disclose it to, how long we keep it and what rights you have over it.
We issue this Notice under section 7 of the Personal Data Protection Act 2010 ("PDPA"). It applies to the MyBina website, the MyBina mobile application, our printed subscription products including Construction Watch, and to any dealing you have with us by email, telephone or post.
Please read this Notice before you register for an account or send us your details. By registering, subscribing or continuing to use MyBina, you confirm that you have read and understood it.

3. PERSONAL DATA WE COLLECT We group the data by the reason we hold it, because the reason determines whether you have to give it to us at all.
3.1 Account data (required to hold a subscription) - Your name and the username you sign in with
- Your password, held in encrypted form
- Your company name and your designation within that company
- Your company's postal address, city, postcode and state
- Your contact telephone or mobile number
- Your email address
- Your subscription type, access level and subscription expiry date
Without these we cannot create your account, deliver your subscription or raise a valid invoice, so this set is mandatory for subscribers.
3.2 Billing and e-Invoicing data (required by law once we invoice you) Malaysian law requires us to submit electronic invoices to the Lembaga Hasil Dalam Negeri (LHDN) through the MyInvois system. To produce a valid e-Invoice we collect and record:
- The registered name of the buyer
- Tax Identification Number (TIN)
- Business Registration Number (BRN) where the buyer is a company
- Where the buyer is an individual rather than a company, an identification
number, which may be a MyKad (NRIC) number, a passport number or a
MyTentera number
- SST registration number, where applicable
- Billing email address and telephone number
- Full billing address, city, postcode and state
We collect these because the Income Tax Act 1967 and LHDN's e-Invoice requirements oblige us to. We cannot issue you a compliant invoice without them, and we do not use them for any purpose other than billing, tax reporting and our own accounting records.
3.3 Data you choose to give us, for features that are entirely optional
Some parts of MyBina only work if you give us a particular detail. These features are opt-in. If you would rather not provide the detail, simply do not use the feature. The rest of your subscription is unaffected.
- Email address for password reset. If you want to be able to reset your own password, we need a working email address or mobile number to send the reset to. If you do not provide one, you can still use MyBina, but you will need to contact us directly to have a password reset.
- Email address for alerts and notifications. Project alerts, company alerts and newsletters are sent by email. You choose whether to switch these on, and you can switch them off again at any time.
- Location. The "Near Me" features show projects and companies close to where you are. The application asks for your device location the first time you open one of those screens. If you decline, only those screens are unavailable; everything else in the application continues to work. Your location is used to run that one search and to calculate straight-line distances. We do not track your movements, we do not record a location history, and we do not collect location while the application is closed or in the background.
- Notes, actions and team data. If you use the workspace features to keep notes, reminders or shared team lists, the content you type is stored against your account so that you and the colleagues you share it with can see it.
3.4 Data collected automatically when you use MyBina - Your IP address and the date and time you sign in, recorded in an access log so that we can detect misuse of an account
- A session cookie or, in the mobile application, a session token, so that you stay signed in between pages
- Cookies and browser local storage that remember your choices as you move around the site, so that it behaves the way you left it. See section 12.
- Basic technical information sent by your browser or device as part of an ordinary web request
We do not use advertising networks, tracking pixels or third-party analytics services anywhere on MyBina. The sponsor and advertisement panels on our pages are ordinary image files hosted on our own server. They are not supplied by an advertising network, they do not follow you to other websites, and displaying them tells nobody outside our company anything about you.
4. WHY WE USE YOUR PERSONAL DATA We use it to:
- Create your account and sign you in
- Give you the level of access your subscription entitles you to
- Deliver the service, including the project and company information you subscribe to
- Post printed subscription products such as Construction Watch to your company's address
- Issue invoices, receipts and credit notes, and submit e-Invoices to LHDN
- Send you the alerts and notifications you have asked for
- Answer your enquiries and provide support
- Tell you when your subscription is due for renewal
- Keep the service secure and investigate misuse of an account
- Meet our obligations under Malaysian tax, company and other law
5. HOW WE USE YOUR ADDRESS We post printed subscription products, including Construction Watch, to the company address you give us. We use your company's business address for this purpose. We do not need, ask for or use your home or personal address for deliveries (Unless specifically requested).
6. HOW WE COMPILE OUR PROJECT AND COMPANY RECORDS The service we sell is a database of construction projects in Malaysia, the companies working on them and, in some cases, the person to contact at those companies. Part of that database is personal data about individuals who are not our subscribers and who have never dealt with us directly. This section explains where it comes from and what to do if a record concerns you.
6.1 We compile it from public sources only Every project and company record in MyBina is built from information that is already in the public domain. Our sources are:
- Tender notices and tender results published by government departments, agencies, statutory bodies and local authorities
- Announcements, filings and disclosures published by listed companies and by regulators
- Registers and directories published by industry bodies and licensing authorities
- Company websites, press releases and published corporate literature
- Reports and notices carried in newspapers, trade publications and other media
- Information displayed openly at a project site, such as a project signboard, including photographs taken of it
- Information a company gives us itself, or asks us to publish or correct
We do not buy personal data from data brokers or list vendors. We do not take information from confidential or leaked sources, and we do not obtain it by accessing any system we are not entitled to access.
6.2 What a record may contain about an individual Where we hold a named contact for a company, the record may include that person's name, job title or designation, work telephone number and extension, mobile number, fax number and work email address.
These are business contact details, recorded so that a subscriber can approach the right person at a company about a construction project. We do not collect or publish home addresses, identification numbers, or any other private detail about these individuals.
6.3 Who can see it Project and company records are shown to paying subscribers inside the member area and in our printed subscription products. They are not published on the open internet, and we do not sell or rent them on as a mailing list.
6.4 If a record concerns you If you appear in one of our records, you do not need to be a subscriber to deal with us about it. Write to bestinfo@mybina.com.my with "Privacy Policy" in the subject line and tell us what you would like us to do. You may ask to see what we hold about you, ask us to correct it, or ask us to remove your contact details from the record. The rights set out in section 11 apply to you in the same way as they apply to our own members.
Subscribers who notice an error in a project or company record can also report it to us through the member area, and we will check it against thesource.
7. DISCLOSURE OF YOUR PERSONAL DATA We do not sell your personal data. We do not rent, trade or give it away. We do not pass your name, address, telephone number or email address to other companies so that they can market to you.
We disclose personal data only in these situations:
7.1 To parties who help us run the service, and only what they need - Lembaga Hasil Dalam Negeri (LHDN), through the MyInvois system, for the e-Invoices we are required by law to submit
- Our web hosting provider, which stores the data on our behalf. The email we send you is generated by the mail server on that same hosting account, so your email address is not passed to any separate mailing service.
- The postal or courier service that delivers your printed products
- Google, when the mobile application or the website displays a map or converts an address into map coordinates
- Expo, the service that delivers push notifications to the mobile application, where you have switched notifications on
- Our banks, auditors and professional advisers, where needed
These parties may only use the data to perform that service for us. They are not permitted to use it for their own purposes.
7.2 Where the law requires it We will disclose your personal data without notice to you where we are required or permitted to do so by law, or where we believe in good faith that disclosure is necessary to comply with a court order or lawful requestfrom an authority, to enforce our agreement with you, to protect our legal rights or property, or to protect the safety of any person.
7.3 On a transfer of the business If our business or any part of it is sold or reorganised, personal data may be transferred to the acquiring party, who would remain bound by this Notice.
8. TRANSFER OF DATA OUTSIDE MALAYSIA Your personal data is stored on servers used by MyBina. Some of the service providers listed in section 7.1, in particular Google and Expo, operate servers outside Malaysia, so limited data may be processed abroad in the course of displaying a map or delivering a push notification. Where that happens we take reasonable steps to satisfy ourselves that the recipient protects the data to a standard comparable to the PDPA. By using those features you consent to that transfer.
9. SECURITY We protect your personal data with several layers of security rather than relying on any single measure. These include encrypted connections between your browser or device and our servers, database credentials held outside the publicly accessible part of the website, access controls that limit which of our staff can see which records, separate and expiring session tokens for the mobile application, and passwords stored in encrypted form and never displayed back to anyone.
No system connected to the internet can be guaranteed to be completely secure, and we do not claim otherwise. What we do undertake is to apply reasonable technical and organisational measures, to keep them under review, and to act promptly if a problem is found.
10. HOW LONG WE KEEP YOUR DATA - While your subscription is active, and for as long as you keep an account with us, we retain your account data so that the service works.
- Invoices, receipts, e-Invoice records and the billing details they contain are kept for seven years from the end of the relevant financial year. We are required to do this by section 82 of the Income Tax Act
1967 and by LHDN's record-keeping requirements.
- Other account data is deleted or anonymised once it is no longer needed for the purpose it was collected for, and in any event within seven years of your subscription lapsing.
- Access logs are kept only for as long as they are useful for security purposes.
11. YOUR RIGHTS Under the PDPA you have the right to:
- Ask for a copy of the personal data we hold about you
- Ask us to correct data that is inaccurate, incomplete or out of date
- Withdraw your consent to our processing of your data, in whole or in part
- Ask us to stop using your data for direct marketing, which we will act on without charge
- Limit the way we process your data
You can view and update most of your own details from your account once you are signed in. For anything else, write to bestinfo@mybina.com.my with "Privacy Policy" in the subject line, and tell us what you would like us to do. We may need to verify your identity before we act, to make sure we are not disclosing your data to somebody else. We aim to respond within 21 days.
Please note that if you withdraw consent to data we need in order to provide the service, or ask us to delete it, we may no longer be able to keep yoursubscription open. We will tell you before that happens. Withdrawing consent does not affect records we are legally required to keep under section 10.
12. COOKIES AND LOCAL STORAGE We use cookies, and a similar browser feature called local storage, for two reasons.
12.1 To keep you signed in When you sign in, we place a session cookie that identifies you to the site so that you do not have to sign in again on every page. This one is essential. It is removed when your session ends, and if you block it you will not be able to sign in at all.
12.2 To remember your preferences and make the site easier to use As you use MyBina we also store small pieces of information about how you have set the site up for yourself, so that it behaves the way you left it the next time you visit. These remember things such as which panels and sections you have opened or collapsed, the state of a listing you were working through, and notices or alerts you have already seen and dismissed.
This is a convenience. Nothing here identifies you to anybody else, and none of it is needed to sign in. If you clear it, the site still works; you will simply find it reset to its default appearance.
12.3 What we do & not do We do not use advertising cookies. We do not use cookies to build a profile of you, and we do not allow any third party to place a tracking cookie through MyBina. Nothing we store is used to follow you to other websites.
Most browsers let you see, block or delete cookies and local storage through their settings, and you can do so at any time.
13. THE MYBINA MOBILE APPLICATION The mobile application uses the same subscription and the same personal data as the website. Three points are specific to it:
- Location is requested only when you open a "Near Me" screen, is used only for that search, and is never collected in the background. See section 3.3.
- Push notifications are sent through the Expo push service. To send them we register an anonymous device token, which identifies your installation of the application and nothing else. You can turn notifications off inside the application or in your device settings, and you can remove the token by signing out.
- The application contains no advertising, no analytics service and no third-party tracking of any kind.
14. ACCURACY We rely on you to keep your details accurate. Please update your account, or tell us, if your company address, designation, telephone number or email address changes. Out-of-date billing details are a common cause of an e-Invoice being rejected by LHDN.
15. LANGUAGE This Notice is issued in English. A Bahasa Malaysia version will be made available, and in the event of any inconsistency between the two versions the English version shall prevail to the extent permitted by law.
16. CHANGES TO THIS NOTICE We may update this Notice from time to time. The current version is always published at www.mybina.com.my and the effective date at the top tells you when it last changed. Where a change materially affects how we use your personal data, we will notify subscribers by email. Continuing to use MyBina after a change takes effect means you accept the updated Notice.
